Electronic marketing in Uganda

There is no specific legislation that governs electronic marketing in Uganda. However, a few related laws regulate certain aspects of electronic marketing, such as:

  • The Electronic Transactions Act, Cap. 99, which requires that unsolicited commercial communications to consumers are only made at no cost and with the option for the consumer to opt-out of such communications.
  • The Uganda Communications (Consumer Protection) Regulations 2019, which prohibit telecommunications operators from engaging in unsolicited telemarketing, except in accordance with the consumer’s preferences as recorded in the service agreement.
  • The Uganda Communications Advertising Standards, which set out the standards pertaining to advertising and telemarketing, including a prohibition against telemarketing that exhorts or encourages children to contract for the purchase of goods or services.
  • The Data Protection and Privacy Act, which requires data controllers to comply with a data subject’s request to stop processing the data subject’s personal data for purposes of direct marketing.
