Electronic marketing in Colombia

Law 527 of 1999 (Law 527) regulates e-commerce and electronic marketing, but there is no specific regulation regarding data privacy on electronic marketing. In any case, the Data Subject's consent is required for marketing, whether electronic or not and the processing of any personal data for this purpose shall be in accordance with Law 1581.

Additionally, Law 2300 of 2023 requires issuers of marketing material disseminated through phone calls, e-mail, SMS, and web application messaging to request consumers' authorization to receive such material through specific contact channels (e.g., e-mail, web applications, etc.). Such messages can only be sent Monday through Friday from 7:00 AM to 7:00 PM, and on Saturdays from 8:00 AM to 3:00 PM, excluding any contact on Sundays and holidays unless the consumer expressly requests to be contacted at a different time. In each case, the law expressly establishes that prior, express and informed consent from the data subject is required for the processing of personal for marketing  and collection purposes.
