Data protection laws in Brunei

In Brunei Darussalam, the Personal Data Protection Order, 2025 ("PDPO") was enacted on 8 January 2025, with most substantive provisions commencing on 1 January 2026, to govern the collection, use and disclosure of personal data in Brunei Darussalam.

The PDPO applies to all types of private sector organisations, including commercial and non-commercial bodies, irrespective of whether such organisations are recognised under the laws of Brunei Darussalam or maintain a physical presence or is registered as a company in Brunei Darussalam. The PDPO does not apply to government agencies, however, data processors from private sector organisations which process personal data on behalf of government agencies are subjected to the provisions of the PDPO. There are existing legal and policy frameworks for government agencies such as the Official Secrets Act (Chapter 153), Protective Security Manual and the Guidelines on Personal Data Sharing.

The PDPO does not apply to personal data contained in 100-year-old (or older) records, nor does it apply to personal data concerning individuals who have been deceased for a period exceeding 10 years.
